Zachary M. Mattison is a partner in the Litigation Practice. He handles all areas of litigation, with a focus on commercial, construction, banking and personal injury matters. This includes litigating in both state and federal courts to represent healthcare facilities, hospitals, municipalities, accounting firms, manufacturers and individuals. Mr. Mattison also handles both residential and commercial construction litigation issues, especially in the area of mechanic’s lien law. He has successfully collected accounts receivable for large local and national clients, and both prosecuted and defended personal injury claims involving serious and catastrophic injuries.

  • Acted as assistant trial counsel when obtaining a favorable jury verdict for a local commercial real estate brokerage company relating to insurance coverage issues.
  • Successfully arbitrated on behalf of a commercial property owner based on the general contractor’s defective construction and improper mechanic’s lien. 
  • Represented a national banking institution on various matters, including claims under the Uniform Commercial Code for forged and altered checks. 
  • Handled litigation and negotiated resolutions of mechanic’s lien issues for a regional grocery retailer. 
  • Defended numerous snowmobile clubs and associations across New York State in personal injury actions.
  • Handled actions for the collections of accounts receivable for numerous commercial entities, including construction equipment leasing groups, fuel and propane suppliers, commercial retail outlets and nursing homes. 
  • Acted as assistant trial counsel when obtaining a favorable jury verdict in federal court in Pennsylvania, dismissing claims of tortuous interference with a contract.
  • Litigated products liability actions in numerous nationwide federal and state court jurisdictions on behalf of a medical device manufacturer.
  • Leonard v. Schrader, 921 N.Y.S.2d 918 (3d Dept. 2011). Successfully convinced the appellate court to reverse the lower court’s denial of the defendant’s motion for summary judgment in a defamation action.
  • Brinkerhoff v. County of St. Lawrence, 24 Misc.3d 426 (N.Y. Supreme Court 2009). Obtained the dismissal of wrongful death claims made under a statute that provides police officers and firefighters the right to sue for injuries sustained in the line of duty.
  • Parkis v. Microsoft Corp., No. 5:09-CV-110 (FJS/GHL), 2009 WL 1585003 (N.D.N.Y. 2009). Defended Microsoft Corporation in a federal court class action litigation involving alleged defects in the xBox 360.
  • Warren v. Ellis, 61 A.D.3d 1351 (4th Dept. 2009). Obtained an order reinstating plaintiff’s action for injuries he sustained when a concrete stair fell out from beneath his feet causing him significant injuries.
  • Dungan v. The Academy at Ivy Ridge, 249 F.R.D. 413 (N.D.N.Y. 2008). Represented a potential class of 1,800 plaintiffs alleging educational fraud.
